Nursing Mother Supplies “Breastfeeding is Green” Contest Rules:
 

1. Eligibility. No purchase is necessary to enter the Nursing Mother Supplies “Breastfeeding is Green” contest. In accordance with these rules (the "Rules"), this Contest is open to all individuals, 21 years of age or older as of the date of entry, who are legal residents of the contiguous United States. All employees and consultants of Nursing Mother Supplies, members of their immediate families, or those with whom they are domiciled, are not eligible. In addition, anyone living in a state where the Contest is prohibited, taxed, or otherwise restricted under state and local laws, rules, or regulations is ineligible. Nursing Mother Supplies expressly disclaims any responsibility or liability for any entrant who enters when it is illegal for them to do so. By entering this Contest, entrants agree to waive any additional rights granted in regard to contests by the state in which they are domiciled.

2. How to Enter. Entries may be submitted by email to contest@nursingmothersupplies.com. The email must include the following: name, address, e-mail address, phone number, and “Breastfeeding is Green” catch phrase. Also, this information can be sent to Contest at Nursing Mother Supplies, 65 W. Conestoga Rd, Devon, PA 19333. All entries must be received on or before 11:59 p.m. EST on April 30th, 2008. Nursing Mother Supplies assumes no responsibility for lost, late, or misdirected entries. Proof of transmission of an entry will not constitute proof of receipt of said entry. Limit one entry per person. The contest may be extended at Nursing Mother Supplies discretion to ensure a broader entry pool.

3. Winning. All timely entries will be collected, and then the winning entry will be selected by Nursing Mother Supplies based on creativity, and overall appeal. The winner will be announced on May 12, 2008 (unless the contest has been extended) and shall be notified that he/she may claim the prize by e-mail, first class mail or phone based on the information provided in the entry form. If the winner does not claim the prize within ten (10) days of the first notification attempt, such person may be disqualified and an alternate will be selected in accordance with these rules. Prior to being declared the winner, the potential winner will be required to sign before a notary and return an Affidavit of Eligibility and Prize Acceptance/Liability and (where legally permissible) a Publicity and Copyright Permission Release Form within ten (10) business days of receipt. Non-compliance may result in disqualification and the Contest prize will be awarded to an alternate Prize Winner among all remaining entries. The winner shall be required to provide a photocopy of a valid driver's license or other identification before receiving any prize. We may also request confirmation of your social security number, if, in our discretion, it is necessary to report your winnings to the Internal Revenue Service, or applicable state taxing authority. If you are chosen as the winner, Nursing Mother Supplies will coordinate shipping arrangements with you. We will ship to one destination.

4. Once the winner is chosen, the phrases becomes the sole property of Nursing Mother Supplies and may not be used by the winner in any way. If the phrase is used to make a profit Nursing Mother Supplies has the right to go after the profit in a court of law that is intended for charity.

5. Prize. The winner will receive a Nursing Mother Supplies breastfeeding gift basket valued at $300, his/ner catch phrase printed on t-shirts (all proceeds going to charity) and the choice of which environmental organization should receive fifty percent of the proceeds from the sale of the t-shirts. No cash redemption. The organization chosen by the winner to receive fifty percent of the profits generated must be a charitable non-profit organization. Nursing Mother Supplies can decide the charity is not appropriate, at which point the winner can select another organization.

6. Legal Considerations. The odds of winning depend on the number of eligible entries received. Upon shipment to the winner's address, Nursing Mother Supplies will be deemed to have awarded the prize to the winner with the winner assuming full responsibility for the prize. Except for shipping costs, which will be paid by Nursing Mother Supplies, the winner, and not Nursing Mother Supplies, is solely responsible for all other arrangements, costs and expenses associated with receiving the prize, including without limitation, any taxes or other fees imposed by a government authority. All entrants agree that submitting the entry constitutes agreement to the terms and conditions of these Rules. The winner shall be required to sign an additional liability waiver and statement of eligibility before receiving any prize. By submitting an entry form, the entrant is representing and warranting to Nursing Mother Supplies that he/she is an eligible contestant.

7. Indemnifications and Disclaimer. Each entrant agrees to indemnify, defend and hold harmless Nursing Mother Supplies and its representatives, agents, and employees from any and all liability whatsoever for any injuries, losses, or damages of any kind arising from or in connection with, either directly or indirectly: (1) the entrants breach of any representation or warranty contained herein, (2) awarding, acceptance, receipt, possession, use, and/or misuse of any prize awarded herein; or (3) participation in the Contest. Nursing Mother Supplies is not responsible for incorrect or inaccurate entry of information including, but not limited to, technical malfunctions, human error, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, entry materials that have been tampered with, or entries that are illegible, late, lost, damaged, or misdirected.

8. Amendments; Termination. Nursing Mother Supplies reserves the right to cancel, terminate, modify, or suspend this Contest for any reason, including but not limited to, fraud, technical failures, or any other causes beyond the control of Nursing Mother Supplies that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest.

9. Governing Law. This Contest shall be interpreted and governed by the laws of the State of Pennsylvania and any applicable laws and regulations of the United States. The entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively, before a state or federal court located in Chester County, Pennsylvania having competent jurisdiction, which Court shall apply the laws of the State of Pennsylvania without regard to any principles of conflicts of laws, and submission of said entry constitutes acceptance of such laws. The entrant further agrees that no claims, judgments or awards shall exceed the amount of the Contest prize and under no circumstances shall include attorney's fees; nor shall any entrant be permitted to obtain awards for punitive, incidental, consequential, or other similar damages or have any damage awards multiplied or increased for any reason.

10. General. By entering this Contest, and accepting a prize, entrants: (1) agree to be bound by these rules; (2) agree to release Nursing Mother Supplies and their affiliates from all liability, claims, action or proceedings related to the Contest and from injuries or damages relating to acceptance or use of the prize; and (3) consent to the use of his/her name, voice, picture and likenesses and winning entry for editorial, advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law.
